The Land

Lot 1: Land at Waltham (19.31 acres STS)



The land is accessed directly off Ings Lane and the gate is located on your left as you reach the end of the lane. This parcel of land extends to an area of approximately 19.31 acres of pasture land which is classified as Grade 3 on the MAFF provisional Agricultural Land Classification of England and Wales.



The land is in a strong agricultural area and is capable of being converted into arable production.



Lot 2: Land at Holton le Clay (4.50 acres STS)

The land is accessed via Lot 1 as shown blue on the plan overleaf. The selling agents have been made aware of a prescriptive right of way to Lot 2 via the north of the site. A further plan can be seen which indicates said prescriptive right of way as orange.

Further information can be obtained from the selling agents. The field extends to 4.5 acres of pasture land which is also classified as Grade 3 land.



Like Lot 1, although the land is currently pasture, it is capable of conversion into productive arable land.



Tenure

Currently the property is subject to an Agricultural Holdings 1986 Act Tenancy dated 15th January 1992. The tenant has entered into a formal deed of surrender. Confirmation of which is available from the selling agents upon request. The land can therefore be sold with vacant possession upon completion of the sale.



Basic Payment Scheme

The land is registered with the Rural Payments Agency. The tenant owns the entitlements for the land and are available to purchase by separate negotiation.



Wayleaves, Easements, Covenants and Rights of Way

The land is sold subject to and with the benefit of all existing wayleaves, easements and rights of way, whether mentioned in these particulars or not.



Overage Clause

Both lots are subject to an overage provision whereby 40% of any uplift in value brought about by obtaining planning permission for use other than agricultural or non-commercial equestrian use, together with any mineral value found within the ground will be payable to the vendor. These provisions will apply for a period of 30 years and payment will be due upon the earlier of implementation of the planning permission or sale of the land with the benefit of planning permission.



Boundaries

The purchaser(s) shall be deemed to have full knowledge of all boundaries and neither the seller nor the selling agents will be responsible for defining ownership of the boundaries.

The areas have been prepared within the offices of the sole agent and the information is based upon the Rural Land Registry information and Promap.
